Disparate Impact on the Docket

Disparate impact may finally have its day in court as the U.S. Supreme Court is scheduled to begin hearing arguments on Jan. 21. Previous cases involving the controversial concept, in which neutral practices that have a discriminatory effect are considered actionable, have settled before reaching the nation's top court.
